Terms of Service

1. Acceptance of Terms

By accessing or using the Chillead platform ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms. If you do not agree to these Terms, you may not use the Service.

2. Description of Service

Chillead provides an AI-powered business operations platform including CRM, auto-dialer, dispatch, invoicing, field technician management, and automation tools. The Service is delivered as a cloud-based software-as-a-service (SaaS) application accessible via web browser and mobile devices.

3. Account Registration

To use the Service, you must create an account with accurate and complete information. You are responsible for maintaining the security of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized access at security@chillead.com.

4. Subscription & Billing

The Service is offered on a monthly subscription basis. All plans include flat pricing with no per-user fees, no setup costs, and no annual contract requirements. You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period. We do not offer prorated refunds for partial months.

5. Free Trial

New accounts may be eligible for a 14-day free trial. No credit card is required to start a trial. At the end of the trial period, you must subscribe to a paid plan to continue using the Service. Your data will be retained for 30 days after trial expiration, after which it may be permanently deleted.

6. Acceptable Use

You agree not to use the Service for any unlawful purpose, to send spam or unsolicited communications, to transmit malware or malicious code, to interfere with the Service or its infrastructure, to attempt to gain unauthorized access to other accounts, or to violate any applicable telecommunications regulations (including TCPA compliance for auto-dialer usage).

7. Data Ownership

You retain all rights to the data you upload, create, or manage through the Service ("Your Data"). We do not claim ownership of Your Data. You grant us a limited license to process, store, and display Your Data solely for the purpose of providing the Service. You may export Your Data at any time through the platform settings.

8. White-Label Terms

If you use the white-label features of the Service, you are responsible for ensuring that your branding, content, and use of the platform comply with all applicable laws. You may not misrepresent the origin of the Service in a way that could mislead consumers. White-label features are available on Growth and Scale plans.

9. Service Availability

We strive to maintain 99.9% uptime for the Service. Planned maintenance windows will be communicated in advance. We are not liable for interruptions caused by factors outside our control, including internet outages, third-party service failures, or force majeure events. Scale plan customers receive SLA guarantees.

10. Limitation of Liability

To the maximum extent permitted by law, Chillead Technologies shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service. Our total liability shall not exceed the amount paid by you for the Service in the twelve (12) months preceding the claim.

11. Modifications to Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated via email or through a prominent notice on the platform at least 30 days before they take effect. Continued use of the Service after changes constitutes acceptance of the modified Terms.
